Section-A (खण्ड-क)
Note: Attempt all five questions. Each Question carries 4 marks. Very short answer is required not exceeding 75 words.
नोटः सभी पांच प्रश्नों के उत्तर दीजिये । प्रत्येक प्रश्न 4 अंक का है। अधिकतम 75 शब्दों में अति लघु उत्तर अपेक्षित हैं ।
1. Name the doctrine "Generic words must follow the specific words."
सिद्धान्त का नाम लिखें जिसका अर्थ है, “साधारण शब्द अपने पूर्ववर्ती विशिष्ट शब्दों का अनुसरण करता है । "
2. Can an explanation clause enlarge the scope of original section?
क्या स्पष्टीकरण खण्ड मूल उपबन्ध (धारा) के विस्तार को बढ़ा सकता है?
3. Why should a taxing statute be strictly construed?
कर अधिनियम का कठोरता से अर्थ क्यों करना चाहिए?
4. Define the rule of 'Stare decisis'.
'निर्णीत अनुसरण' नियम को परिभाषित कीजिए ।
5. Explain the rule 'Casus Omissus'.
'यथाभाषा निर्वचन' सिद्धान्त को समझाए ।
Section-B (खण्ड-ख)
Short Answer Questions ( लघु उत्तरीय प्रश्न )
Note: Attempt any two questions out of the following three questions. Each question carries 10 marks. Short answer is required not exceeding 200 words.
नोटः निम्नलिखित तीन प्रश्नों में से किन्हीं दो प्रश्नों के उत्तर दीजिये । प्रत्येक प्रश्न 10 अंक का है। अधिकतम 200 शब्दों में लघु उत्तर अपेक्षित है ।
6. Contemporanea expositio will not always be decisive of a question of construction. Discuss
समकालिक व्याख्या सदैव अर्थ के प्रश्न के लिए निश्चयात्मक नहीं है। विवेचना कीजिये ।
7. Discuss the doctrine of "Noscitur a sociis".
'सहचारी शब्द ' सिद्धान्त की विवेचना कीजिए ।
8 Explain "Reddendo Singula Singulis". doctrine.

Note: Attempt any three questions out of the following five questions. Each question carries 20 marks. Answer is required in detail.
नोटः निम्नलिखित पांच प्रश्नों में से किन्हीं तीन प्रश्नों के उत्तर दीजिये। प्रत्येक प्रश्न 20 अंक का है। विस्तृत उत्तर अपेक्षित है।
9. How does Golden Rule of Interpretation differ from Literal Rule?
निर्वचन सम्बन्धी “स्वर्णिम नियम" " शाब्दिक नियम" से किस प्रकार भिन्न है ?
10. "The words of statute, when there is a doubt about their meaning are to be understood in the sense, in which they best harmonise with the subject matter of the enactment". Discuss.
“अधिनियम के शब्द जबकि उनके अर्थ में संदेह है, उस अर्थ में समझे जाते हैं जिनमें वे अधिनियम की विषय वस्तु के साथ सर्वोत्तम रूप में सामजस्यपूर्ण होते हैं ।” विवेचना कीजिए ।
11. Explain 'Retrospective operation of Statistics'. Give reference of some decided cases.
'संविधियों का भूतलक्षी प्रवर्तन' की व्याख्या कीजिए। कुछ विनिश्चित वादों का हवाला दीजिए ।
12. What canons of interpretation Indian judiciary adopts while interpreting the Indian Constitution? Examine.
भारतीय संविधान का निर्वचन करते समय भारतीय न्यायपालिका निर्वचन के किन सिद्धातों की अपनाती है ? विवेचना करें ।
13. Is a penal statute capable of wide interpretation ? If so, in what circumstances?
क्या एक 'दण्डात्मक विधि' विस्तृत अर्धान्वयन किये जाने योग्य है ? अगर हाँ, तो किन परिस्थितियों में?
